Bow Holdings Ltd.
(the "Company") is launching “BuzzApp” – a Contest for the best mobile
application (“App”) that uses buzzdoesTM (the “Contest”).
These are the Contest rules (the "Rules"). By participating in the
Contest, you agree to these Rules.
2.
Eligibility
Participants must be buzzdoesTM registered users. Registration for
buzzdoesTM is available at:
www.buzzdoes.com . Registration for buzzdoesTM is subject to the
buzzdoesTM Developer License Agreement, available at:
http://www.buzzdoes.com/portal/DevLicense.aspx
Employees, officers, and directors of the Company, along with their affiliated
entities, subsidiaries, advertising and promotion, legal advisors, their
immediate family members and persons living in their same household, are not
eligible to enter the Contest.
The Contest is void wherever restricted or prohibited by law. The Contest is
contingent upon a minimum number of App submissions, in the sole discretion of
the Company.
3.
Official Rules
By entering the Contest, participant fully and unconditionally agrees to and
accepts these Rules and the decisions of the Company, which are final and
binding in all matters related to the Contest. Whether a participant is eligible
to win a prize is contingent upon fulfilling of all requirements set forth
herein.
4.
Timing
The Contest submission period begins on April 19, 2012, at 15:00 pm EST and ends
on July 11, 2012, at 12:00 pm EST (the “Submission Period”). The Company’s
computer systems are the official time keeping device for the Contest. The
Company can extend the Submission Period at its sole discretion.
5.
How to Participate?
In order to participate, Apps developers must integrate buzzdoesTM in
their Apps and upload it with buzzdoesTM to the Apple App Store or
Google Android Market (together “The Markets”), during the Submission Period.
Apps must be live with buzzdoesTM in one of The Markets by 31st
of May 2012.
Participants must be the rightful owners or have authorized use of the App.
Entries that are late, illegible, incomplete, damaged, delayed, lost, tampered
with, incomprehensible, forged or otherwise not in compliance with these Rules
will be disqualified.
6.
Winners
Determination
Winners will be determined by the Company, in its sole discretion. The top 25
Apps will be chosen from all eligible submissions, out of which the top three
winning Apps (the "Winners") will award their respective participants one
of the Contest's prizes. Winners will be determined by the Company, in its sole
discretion, based on considerations such as their creativity, user friendliness,
design and novelty.
7.
Prizes
The Contest prizes are -
1st place: 5,000 US$
2ND place: 3,000 US$
3rd place: 2,000 US$
The Company may decide, in its sole discretion, not to award any or all of the
above prizes.
8.
Announcements and
payments
The Winners will be announced on 19th July and will be notified of
their winning by email (via the email address that the participant provided
during the registration process). The Company, or anyone acting on its behalf,
is not responsible for late, lost, or misdirected notification. The prizes will
be transferred to the Winners’ PayPal account or by cheque (in the Company sole
discretion) within two weeks of the announcement. The Company may, in its sole
discretion, verify the eligibility of the Winners prior to awarding the prize.
If a Winner cannot be contacted through his email address, or the prize is
undeliverable due to incorrect PayPal account details, the Winner forfeits the
prize. If a Winner is disqualified for any reason, the Company will decide on
the next eligible participant in accordance to these Rules, who will be deemed a
Winner instead. Only three alternate Winners will be selected through this
process, after which the relevant prize will remain un-awarded.
Winners are solely responsible for the payment of any taxes deriving from the
payment of the prizes.
9.
Personal Information
The Company may display Winners' names and App details. Other personal
information collected through the Contest is subject to the Company's Privacy
Policy, available at

10.
LIMITATION OF
LIABILITY
PARTICIPANTS AND WINNERS RESPECTIVELY AGREE TO RELEASE AND HOLD HARMLESS THE
COMPANY AND ITS RESPECTIVE SUBSIDIARIES, AFFILIATES, SUPPLIERS, DISTRIBUTORS AND
EACH OF THEIR RESPECTIVE PARENT COMPANIES AND EACH SUCH COMPANY'S OFFICERS,
DIRECTORS, EMPLOYEES AND AGENTS FROM AND AGAINST ANY LOSSES, DAMAGES, RIGHTS,
CLAIM OR CAUSE OF ACTION OF ANY KIND, INCLUDING, BUT NOT LIMITED TO, PERSONAL
INJURY, DEATH, OR DAMAGE TO OR LOSS OF PROPERTY, ARISING, IN WHOLE OR IN PART,
DIRECTLY OR INDIRECTLY OUT OF ENTERING AND PARTICIPATING IN THE CONTEST OR
RECEIPT OR USE OR MISUSE OF THE PRIZE.
THE COMPANY AND ITS RESPECTIVE SUBSIDIARIES, AFFILIATES, SUPPLIERS, DISTRIBUTORS
AND EACH OF THEIR RESPECTIVE PARENT COMPANIES AND EACH SUCH COMPANY'S OFFICERS,
DIRECTORS, EMPLOYEES AND AGENTS ARE NOT RESPONSIBLE FOR ANY ERROR, OMISSION,
INTERRUPTION, DELETION, DEFECT, OR DELAY IN OPERATIONS OR TRANSMISSION; THEFT OR
DESTRUCTION OR UNAUTHORIZED ACCESS OR ALTERATIONS OF ANY ENTRY, COMPUTER
TRANSMISSIONS, OR FOR TECHNICAL TELEPHONE EQUIPMENT, ELECTRONIC, HARDWARE OR
SOFTWARE, NETWORK, INTERNET, OR COMPUTER MALFUNCTIONS OF ANY KIND; OR INACCURATE
TRANSMISSION OF, OR FAILURE TO RECEIVE ANY INFORMATION BY A WEBSITE ON ACCOUNT
OF TECHNICAL PROBLEMS OR TRAFFIC CONGESTION ON THE INTERNET OR ANY COMBINATION
THEREOF.
11.
Governing
Law, Jurisdiction
All issues related or with respect to the Contest, the prizes and the
Rules will be governed by and construed in accordance with the laws of the State
of Israel, without giving effect to any choice of law or conflict of law rules
or provisions, which would result in the application of the laws of a
jurisdiction other than the State of Israel.
Participant agrees to resolve any dispute or claim that participant may
have against the Company, its respective subsidiaries, affiliates, suppliers,
distributors, each of their respective parent companies, or each such company's
officers, directors, employees and agents and to submit to personal jurisdiction
in the courts in the city of Tel-Aviv, Israel.
12.
General Conditions
The Company reserves the right to cancel, suspend and/or modify the Contest, or
any part of it, if any fraud, technical failures or any other factor beyond the
Company’s reasonable control impairs the integrity or proper functioning of the
Contest, as determined by the Company in its sole discretion. The Company, in
its sole discretion, reserves the right to disqualify any individual it finds to
be tampering with the entry process or the operation of the Contest or to be
acting in violation of these Rules.
